Shipping and Delivery Policy

1. Introduction

This policy governs the transport and delivery of products supplied by Caldor Heat Engineering SRL and is intended to protect customer rights while ensuring full compliance with applicable Romanian and European Union legislation.

As of 01.01.2025, updated rules apply regarding transport organization, insurance, and the allocation of responsibilities related to delivery.

This policy is established in accordance with, but not limited to:

  • Regulation (EU) No 1215/2012
  • Regulation (EU) No 593/2008 (Rome I)
  • Romanian Civil Code (Law no. 287/2009)
  • Incoterms® 2020 principles, where applicable

2. Transport Organized by Caldor Heat Engineering SRL (Insured Transport)

All transports organized by Caldor Heat Engineering SRL are carried out exclusively with insured transport.

Uninsured transport is strictly not accepted and will not be performed under any circumstances when transport organization is requested from Caldor.

This measure is mandatory to protect goods against loss, theft, or damage during transit.

Cost Allocation:

  • If the transport cost is initially supported by Caldor or no special agreement exists, all transport and insurance costs will be charged to the Buyer.

  • If the transport cost is supported by the recipient, the insurance fee is automatically included in the transport cost and paid directly by the Buyer to the transport company.

Legal Acceptance:

By requesting transport organization by Caldor Heat Engineering SRL, the Buyer automatically accepts:

  • the selected carrier,
  • insured transport conditions,
  • and the corresponding transport invoice,

without the possibility of subsequent objection.

3. Transport Organized by the Client

Clients may choose to organize transport independently using a carrier of their choice.

In this case:

  • All responsibility for loss, damage, delay, or deterioration during transport lies exclusively with the Client.
  • Caldor Heat Engineering SRL bears no liability whatsoever for damages occurring after the goods are handed over to the carrier designated by the Client.
  • No claims related to transport damage will be accepted by Caldor in such cases.

This limitation of liability applies in accordance with:

  • Romanian Civil Code, art. 1355–1357, and
  • applicable EU transport liability regulations.

4. Final Provisions

Caldor Heat Engineering SRL shall not be held liable for:

  • transport incidents outside its direct control,
  • damages caused by third-party carriers chosen by the Client,
  • delays resulting from logistics providers, customs, or force majeure.

By placing an order on www.caldor.ro , the Client expressly acknowledges, accepts, and agrees to this Shipping and Delivery Policy without reservation.
